“I wrote to Berkeley Accountants for advice on the implications of capital gain tax and Inheritance tax on me with regard to either gifting or selling of shares in an unquoted trading company to my daughter. Berkeley Accountant responded promptly and accurately with an advice that in the case of outright gift the entire gain could be deferred and if I sell the shares at an undervalue this will restrict the amount of gain chargeable to capital Gain tax and remaining gain could be deferred through gift relief. Further, by claiming Entrepreneur relief the CGT rate will be only 10%.

For Inheritance Tax Berkeley Accountants advised that gift of shares to my daughter would be a Potentially exempt transfer (PET), PET s only become chargeable to IHT if one dies within seven years of making gift. They also advised that Business Property relief should be available as i am gifting shares in unquoted trading company which I have owned for at least two years.

They also advised me that if I sale the shares any cash received from my daughter I can place in a trust, there will be no capital gain tax implications on such transfer of cash.
